AbstractThis practice paper examines the current practice of Hong Kong Lands Department regarding enforcement against breaches of the “user clause” in the Crown (Government) lease. A total of 26 categories of lease drafting approaches regarding user restrictions are identified. It is argued that unless the relevant lease document expressly pins down the limit of ancillary office uses in industrial premises, as in one of the 26 categories identified, no enforcement of such uses shall be instigated.
