Abstract | Under the party-state structure and the long-time tri-partite anticorruption system, corruption laws in China are composed of Chinese Criminal Law (CCL), the Chinese Communist Party’s regulations and disciplines, and administrative codes. In the complicated law hierarchy, Party disciplines are the most authoritative, because they set up fundamental regulations covering broad behaviours considered as corruption and applying to all the Party members, many of whom are government officials. Most corruption cases are also processed within the Party. CCL serves primarily the purpose of defining punishments and sentences in the judicial proceedings. In addition to the three branches of laws, anti-commercial bribery law forbids unfair business competition in China. |
