AbstractResponse to article by Christian Witting (see AGIS No 20070804) concerning the liability attached to breach of a common law non-delegable duty - argument against Witting's claims that breach of non-delegable duty is an independent tort, that common law non-delegable duties are characterised by the imposition of strict liability and that non-delegable duties are primarily concerned with the protection of bodily integrity - strict versus fault-based liability - analysis of relevant Australian and UK case law.
