| Abstract | 香港在港英統治時期主要采用英國的普通法制度。1997年回歸后,根據《中華人民共和國香港特別行政區基本法》,香港特別行政區被授予高度自治權,并保留了原有的普通法制度。香港特區法院適用普通法,將'權力分置'原則視為香港基本法的一個特點與法治原則之一。香港法院運用權力分置原則描述和規范香港特區內部各管治機構之間的關系,并作為法院對于其他管治機構適用不干預原則或司法謙抑的調節器。正如關于香港特區政治體制性質的政治論述所指出,特別行政區實行'行政主導'而非'三權分立'的政治體制,但司法話語中的'權力分置'原則與'三權分立'不同. |
