| Abstract | 本文主要以共享创意或知识共享(CC)为研究对象,探讨其与版权的关系。文章首先简要回顾了CC运动的历史及其许可条款的基本内容,然后分析其与版权法、中介商的关系,最终得出的结论是CC依赖于版权制度,其目的是规避传统的版权内容市场来创造可供选择的内容来源,但其自我强加的体系结构人为地缩小了对其他CC授权作品可用的创造性资源,并且当许可条款被打破时,它也不能克服版权侵权所带来的复杂性。尽管如此,CC仍有其存在的价值,它促进了新中介机构的发展,同时其作为版权法的备选项对创作者也具有很大的吸引力 |
