Abstract | Examines, using theories of contract and legal interpretation, the principles encompassed by the 'agreement' concept under TFEU art.101(1). Presents a theoretical framework of EU treaty interpretation based on legal purpose and ordinary meaning, and compares its operation in contractual and antitrust agreements. Suggests why an agreement is independent of parties' subjective intentions, and encompasses tacit collusion and concerted practices. |
