AbstractThis paper sets out a number of principles to restrict the arbitrariness of NPCSC interpretation, explores the different meanings of act of state and the implication of this common law doctrine in the Basic Law, and proposes strengthening the institution of special advocates in politically sensitive cases and the process of appointment of judges to strengthen independence of the judiciary.
