Abstract | Appellate and first instance judgments dealing with CITIC Pacific's privilege claim cover five important aspects of legal professional privilege. Each is addressed with particular emphasis on partial waiver and exclusion of prosecution evidence of a defendant's privileged communications. The article is intended to expound and clarify relevant law, explore implications of fundamental substantive human right for privilege and raise issues concerning partial or limited waivers. |
