Abstract中國的政治憲法學是新興的理論現象,儘管它受到西方理論的影響,但也有其特殊的背景。當代中國的政治憲法學話語值得研究,它提出一種與居於主流地位的規範憲法學不同的思 路,它的思考進路有利於透視中國憲法體制轉型的真實狀況及其面對的困境。在當代中國政治憲法學的理論脈絡中,高全喜教授是一位重要的學術人物。本文介紹了高全喜的政治憲法學的核心概念和主要內容,並在此基礎上進行反思與評估。 Political constitutionalism is a new school of thought in China. Despite being influenced by its Western counterpart, Chinese political constitutionalism has its unique roots. The current Chinese discourse of political constitutionalism is worth researching because it provides a theoretical perspective different from that of the dominant normative constitutional studies and has a strong analytical power in elucidating the dilemmas and challenges facing China's constitutional transformation. Professor Gao Quanxi is a leading scholar of political constitutionalism in contemporary China. This article discusses the key concepts and main content of his thoughts about political constitutionalism, and reflects on and assesses their significance.
