Abstract | Considers the obligations under the Consumer Credit Act 1974 and the Data Protection Act 1998 concerning the protection of the personal data held by credit reference agencies (CRAs), including: (1) the duty of creditors to inform consumers that credit has been denied on the basis of information supplied by a named CRA; (2) the duties of CRAs to inform consumers that they hold their personal data; and (3) their duties to ensure the accuracy and currency of this data and to correct mistakes. Outlines the rights of consumers when CRAs process personal data incorrectly. [Abstract by Sweet & Maxwell] |
