AbstractDiscusses the challenge that judges can face in resolving neighbouring land boundary disputes. Outlines the legal principles of construing root conveyances. Examines, with reference to case law, the approaches used to determine: (1) the evidential weight of title plans; (2) the admissibility of extrinsic evidence; and (3) the admissibility of subsequent evidence. Suggests that boundary disputes are better suited for mediation than litigation.
