Objectives
1) To investigate how central government agencies, local governments, courts, and individual parties deal with the legal risks and uncertainties of local land reforms. 2) To explore whether the top-down legalist approach to Chinese land reform is the right direction in which to go. 3) To explore reform of the numerus clausus principle in the PRC Property Law to accommodate decentralized innovations to land institutions. 4) To articulate a functional model with clear boundaries and effective interaction between the Chinese central and local governments in land governance and to make legal and policy reform proposals accordingly. 5) To address the tension between respecting the law and promoting social and economic change in Chinese land reform. 6) To shed light on the internal structure and politics of government and add it to the theoretical model on the evolution of property rights.
