Objectives
1 To examine the rationales behind the compensation for pecuniary and non-pecuniary losses in Hong Kong’s personal injury disputes. Special consideration is given to the assessment of damages for PSLA. 2 To construe, characterise and reshape a large number of judicial decisions rendered in Hong Kong in the past 40 years, with a view to formulate a sufficiently well-defined conceptual framework out of a broad notion of ""pain and suffering"". 3 To perform a statistical analysis of the factors that are influential in determining the levels of PSLA awards in Hong Kong, using data from cases collected in Objective (2), and Hong Kong's economic statistics. 4 To explore the feasibility of using PPO as an alternative to the conventional multiplier-multiplicand approach. For this purpose, an indexation methodology will be tailor-made to address the uniqueness of Hong Kong’s social and economic situation.
