| Abstract | 一、香港回歸之前的違憲審查制度 以前曾有人以為殖民地時代的香港法院并不享有審查和推翻立法機關的立法的違憲審查權,其實這是一種誤解。英國法院沒有違憲審查權,卻是一個事實,這是因為英國沒有正式的成文憲法,她長期奉行“國會至上”的憲政體制,任何由英皇會同國會(即英國的立法機關)制定的法律,法院必須忠實地執行;由于并不存在著任何更高層次的憲法文件,所以法院沒有審查國會立法的理論性和實質性的依據(但此傳統看法已因英加入歐洲共同體而逐漸改變)。 |
