| Abstract | 該文作者高樹超博士對2004年中歐焦炭出口配額爭端作了法律分析，並指出歐盟在該案中的爭訟理由並不充分，中國完全可以援引GATT的相關條款來為自己的配額制度辯護。中國之所以急於讓步，是出於其對於運用世貿組織爭端解決機制的排斥心理。實際上，如果運用得當，世貿組織爭端解決機製完全可以被用作維護中國合法利益的有力工具。因此中國應該積極學習世貿組織的規則，充分利用有關規則最大限度地保護自己的合法權益。 |
