| Abstract | 內地改革開放以來,特別是香港回歸后,在“一國兩制”的基礎上兩地關系進一步密切。2004年開始付諸實施的《更緊密經貿關系安排》更使兩地的融合進入了一個新的歷史階段。在這樣一個過程中不可避免地會出現各種各樣的民商事糾紛,并需要通過民事訴訟來解決。這其中必然涉及到的一個關鍵問題就是管轄權的歸屬和行使。它不僅關系到案件的公正順利審理,也關系到進行跨境調查取證和尋求判決承認執行時能否得到有效的合作。 一、兩地民商事案件管轄現行的基本規則和理念 內地人民法院對涉外民商事案件行使管轄權是基于一些法律規定的連接因素。《中華人民共和國民事訴訟法》第243條根據 |
