Abstract | Individuals with intellectual disability, whether born or acquired as a result of illness or accident, depend on others to manage financial assets available for their benefit. In this connection, the trust (both testamentary and inter vivos), adult guardianship and the lasting (or enduring) power of attorney are useful financial planning tools. However, not many people can afford professional trust services. It is also difficult to find willing and reliable guardians or attorneys who agree to act gratuitously. To tackle these problems, the Hong Kong government has decided to launch a territory-wide special needs trust (SNT) for the benefit of these individuals. |
