AbstractVindicatory damages in public law are a novel head of damages. This kind of damages is highly controversial. It is recognized in Canada, New Zealand, and a number of common law jurisdictions but rejected in the UK and HK. This paper provides a comparative survey and commentary of its development in a number of jurisdictions, and argues that vindicatory damages deserve a place in public law.
