Abstract | This article reviews the judicial remedies for a violation of a constitutional right. It argues that there should be a right to stay a declaration of inconsistency in order to avoid disturbing past decisions or creating a legal vacuum for the future. It also argues that there should be a cause of breach of statutory duty based on a breach of the Bill of Rights, which breach shall give rise in appropriate circumstances, vindicatory damages. |
