| Abstract | 知識產權的外部邊界在哪里?內部邊界又怎樣劃分?知識產權法與其他法律之間,以及知識產權法內部之間有沒有明確的邊界?如果有,在哪里?如何劃分?如果沒有,需不需要明確劃分?如果需要,為什么?有沒有可能劃分清楚?如果不需要,又是為什么?有什么好處?這些問題一直困擾著人們,并且至今沒有明確的答案。本文旨在把這些'混亂'的境況呈現給讀者,由此激發大家一起來分析產生這個境況的原因,并探討改變這一境況的可能之方案以及知識產權未來發展的前景。 |
