AbstractThis paper reviews the problems when a statutory provision is struck down for being unconstitutional. This may disturb the past by expunging previous criminal convictions or jeopardizing the future by creating a legal vacuum. Various solutions have been proposed, such as prospective overruling, stay of a declaration of unconstitutionality, temporary validity of legislation, or simply leaving the problems to the legislature. These various solutions are considered.
