AbstractAssesses the Commercial Court ruling in Secure Capital SA v Credit Suisse AG on whether the applicable law for determining if an investor in securities held on the Clearstream intermediated system could sue the provider for breach of the terms of the Notes was English law, the governing law of the Notes, or Luxembourg law, the governing law of Clearstream. Argues that other possible choice of law rules may apply to intermediated securities.
