Hong Kong: post-operative transsexuals have right to marry

Abstract

Considers the Hong Kong Court of Final Appeal decision in W v Registrar of Marriages on whether the Government's position that a post-operative male-to-female transsexual was not a 'woman' within the meaning of the Marriage Ordinance, and so could not marry a man, breached her constitutional right to marry. Suggests that the ruling could open the way for the legalisation of same sex marriage. (Abstract by Sweet & Maxwell )
