AbstractTraditional Chinese forms of communal landholding, t’so and t’ong, are habitually referred to by judges and authors as trusts. This article investigates the basis for this description and examines whether and to what extent the description is legally accurate. It concludes that there is considerable doubt as to whether they really are trusts.
