| Abstract | 作為前英國殖民地,并在1997年成為中華人民共和國的特別行政區,香港為公法與國際人權法的互動提供了有研究價值的一個個案。自1991年起,透過殖民地憲法文件的修訂及立法方式,《公民權利和政治權利國際公約》的人權規范在香港開始具有憲法性效力,并且可為本地法院適用,作為違憲審查中審查立法及政府行為是否違憲的基準。1997年香港回歸祖國后,在根據《中華人民共和國香港特別行政區基本法》成立的新憲制下,香港法院繼續行使這種違憲審查權。本文概述了香港法制中國際人權法規范的適用情況,透過香港近年來的一些重大案例,闡明了公法和國際人權法在香港互動的情況。并試圖在國際及全球性脈絡中,探求香港個案的定位,為研究香港公法與國際人權法的互動和匯流建立一個概念架構。 |
