Objectives
1 Analyse interpretive materials produced by UN human rights monitoring bodies that reference refugee rights, with a focus on CEDAW and the CRC, to clarify the content of current international human rights law as it applies to the refugee protection context. 2 Analyse documents produced during state reporting processes and other interactions with UN human rights monitoring bodies by Asian states not party to the Refugee Convention and conduct interviews with advocates in the region to identify how international human rights law may have influenced states’ policies toward refugees. 3 Test the proposition that international human rights law, with a focus on CEDAW and the CRC which apply to all Asian states, has greater potential to provide a foundation for legal protections for refugees in Asian states not party to the Refugee Convention. 4 Contribute to debates about the continuing relevance of the Refugee Convention in light of developments in international human rights law. 5 Contribute to debates about the effectiveness of international human rights law generally, in Asia, and in relation to refugees in particular.
