AbstractThe Environmental Impact Assessment Ordinance was to provide a framework to assess and evaluate the impact of designated projects on the environment. This paper assessed the scope of individual’s legal rights to the environment provided by the ordinance, and how effectively these rights are accessed under the legal system of Hong Kong. Overall, the provision of environmental justice under the ordinance is satisfactory. But without a recognition of substantial rights to enjoy a clean and healthy environment by individuals, environmental justice will not be comprehensive and sustainable development cannot be achieved.
