Abstract

The Urgency and Importance of Strengthening Research on the First Sino-Japanese War from the Perspective of Public International Law Xu Bijun Abundant accomplishments of the research on the first Sino-Japanese War have been achieved in both China and Japan. However,China is far behind in terms of research on public international law related to this war. The importance of studying this war from the perspective of public international law has not yet been realized in Chinese academia. As a hallmark event,the first Sino-Japanese War gave Japan the membership ticket to Western international society. The study of war is an efficient way to do macro research and get an overall picture of the nature of international law. The study of international law related to this war plays an important role in protecting national interests and strengthening research in this area,and also helps to hold the discourse power by participating actively in creating and reforming the existing international legal system.

中日兩國在甲午戰爭研究領域均取得豐碩成果;然而就甲午戰爭國際法研究而言,無論在數量還是質量上,中國同日本均存在較大差距。甲午戰爭在國際法發展歷程中的重要性并未得到中國學界的足夠關注。甲午中日戰爭是國際法發展歷史中的標志性事件,它使日本成為第一個加入西方國際法體系的亞洲國家;從研究方法上看,研究戰爭是對國際法進行宏觀把握的有效方法,可以幫助研究者全面認識國際法并把握其本質;甲午戰爭國際法研究無論在戰時還是在戰后都對維護國家利益起著至關重要的作用;加強甲午戰爭國際法研究亦有利于中國掌握話語權成為國際法秩序體系的創造者。
